Land Use Committee Meeting Minutes

June 4, 2012

Java Train

 

Members Present: Chris Harkness, Linda Hinderscheit, Kim Moon, Bill Sylvester, Betsy Wehrwein, Curtis Stock

 

Staff Present: Jessie Bronk

 

Others Present:  Mike Maglich, Paul Setter, John Kohler, Dr Christianna Hang, Pao Yang, Amy Brendmoen, Panod Klongtruatroke, and 15 other community residents.

 

Call to Order:  The meeting was called to order at 7:00 p.m. 

 

Adoption of Agenda: The agenda was approved (Hinderscheit-Harkness)

 

Approval of Minutes: Minutes of the 04/30/2012 meeting was approved. (Harkness-Hinderscheit). Passed.

 

Hmong Academy: Dr. Christinanna Hang, Hmong College Prep Academy (HCPA) Superintendent, and Pao Yang, Administrative Operations Director, were in attendance to present information about the proposed addition to the Hmong College Preg Academy at 1515 Brewster Ave. All city permits have already been granted. Portables will be used during construction. There are currently over 700 kids in the K-12 charter school. Projected enrollment will be approximately 1200 after the proposed addition is completed.  None of the students are allowed to drive, so parking needs to accommodate staff only. The new addition will house high school students. HCPA kids perform community service. Mr. Yang suggested we may work together with HCPA on community service projects. HCPA is persuing LEED certification and is working with Xcel Energy. HCPA is seeking a letter of support/no objection from our committee.

 

Motion: Recommend to D10 Council that a letter of support be provided for the HCPA expansion (Harkness-Sylvester) Passed.

 

Walgreens:  John Kohler, Architect for Semper Development, was in attendance to submit two requests from Walgreens: 1.) Extend the delivery hours to 5:30 a.m.-2:00 p.m. from 7:00 a.m.-2:00 p.m., which had been previously approved by District 10; and 2.) Remove the restriction on the hours of operation of the drive-through window.

 

The City of St. Paul has already issued a conditional use permit (for the drive-through window) with the hours recommended by District 10. If the hours are to be expanded, a new conditional use permit would need to be issued. Mr. Kohler does not know if the store will be open 24 hours or not. Neighborhood concerns were expressed regarding the noise generated by deliveries in early morning hours, especially due to the close proximity of the planned delivery area relative to the adjoining residential area.

 

Motion: Write a letter to the City Council re-iterating our desire to maintain the hours for delivery and the drive-through that were recommended by District 10 and contained in the conditional use permit that has already been issued by the City of St. Paul. (Harkness-Sylvester) Passed.  

 

MGM: Paul Setter and Mike Maglich, MGM, were in attendance to discuss two variance requests that have been submitted to the City of St. Paul Board of Zoning Appeals (BZA).

 

1.) 1111 California Ave. West: Request variance for rear yard setback of 23 feet, instead of the required 25 feet.  To meet the 25 foot requirement, the house would need to be moved. The BZA has recommended approval of this request.

 

2.) 1117 California Ave. West: Request variance to retain the addition to the back of the home.  There would be 3.1 feet between the rear wall of the addition and the fence along the Walgreens property. The BZA has recommended denial of the variance request. "The applicant's request to keep the building as is would result in the property not having backyard space; this is not a reasonable request......This requested variance will result in this property being the only lot without a backyard space on the block; the variance will alter the character of the area."  

 

Paul Setter presented their site plan for the homes they own on California Ave. Their rationale for retaining the addition on 1117 California Ave. West would be to keep the third bedroom, thereby increasing the property value of the home. The setback for the new garages from the rear property line will be 3 feet as well. Those in attendance were generally in favor of both variances being granted.

 

Motion: Submit an action item to the District 10 Council to write a letter to the Board of Zoning Appeals in support of both variances requested by MGM for 1111 California Ave. West and 1117 California Ave. West.  (Wehrwein-Stock). Passed.  

 

Mike Maglich encouraged those in attenance to call them if there are any issues during construction. 651-487-1006.

 

New State Representative: State Representative John Lesch was in attendance to introduce himself.  He will represent some of the District 10 area after redistricting.    

 

Adjournment: The meeting was adjourned at 8:08 p.m.
